TERMS AND CONDITIONS OF SALE (TCS)

ARTICLE 1 — PURPOSE
These Terms and Conditions of Sale (TCS) define the rights and obligations of the parties in the context of the online sale of products offered by CUIROMA GROUP SARL via its official website www.cuiroma.com as well as on international partner marketplaces.
CUIROMA GROUP SARL is a Moroccan company specialized in the design, 100% handmade artisanal manufacturing, and worldwide commercialization of genuine leather products.
All products are manufactured in our workshops located in Fez, Morocco, by qualified artisans mastering traditional craftsmanship.
Any order implies full, complete, and unconditional acceptance of these TCS.
ARTICLE 2 — PRODUCTS
CUIROMA GROUP exclusively sells 100% handmade genuine leather artisanal products, made to order.
Each product is unique and may present slight variations due to the artisanal nature of the manufacturing process.
No industrial or mass-produced products are sold.
2.1 — Leather products and natural variations
As leather is a natural material, it may present variations in:
Color
Texture
Grain
Patina
These variations do not constitute a defect.
2.2 — Leather & kilim products (unique craftsmanship)
Some products combine genuine leather and handwoven kilim.
Kilim is a unique artisanal work created by Berber artisans, which means each pattern is different.
Product conformity:
The customer will receive a product conforming to:
Shape
Dimensions
Leather color
Dominant kilim color
Overall style
Accepted variations:
The kilim pattern may vary by up to 20% depending on the artisanal piece.
These variations do not constitute a defect or non-conformity.
2.3 — Product photographs and representation
The photographs, videos, and visuals presented on the website are provided for illustrative purposes.
Due to differences in screen display, brightness settings, shooting conditions, and the artisanal nature of the products, slight differences in color, texture, or appearance may exist between the visuals shown and the delivered product.
These differences do not constitute a lack of conformity.
ARTICLE 3 — PRICES
Prices are indicated in EUR, GBP, or USD depending on the selected currency.
Prices exclude delivery costs.
Prices are those in force at the time of the order.
ARTICLE 4 — ORDERS
Any order is validated after payment.
An order confirmation is sent by email.
As products are made to order, production times are generally 1 to 8 working days, and may extend up to 20 working days during peak periods.
4.1 — Artisanal manufacturing
Each order is individually produced in our workshops.
The production time is not considered a delay.
4.2 — Order cancellation
An order may only be cancelled before production begins.
Once production has started, the order can no longer be cancelled.
ARTICLE 5 — PAYMENT
Payments are secure and processed via PayPal, which also allows card payments.

5.1 — Payment security
All payments are processed via PayPal, a globally recognized secure platform.
CUIROMA GROUP never has access to customers’ banking data.
Transactions are protected by:
SSL/TLS encryption
PayPal anti-fraud systems
3D Secure verification depending on banks
5.2 — Name on bank statement
Depending on the payment method, the transaction may appear under the name PAYPAL or CUIROMA GROUP.
ARTICLE 6 — INTERNATIONAL DELIVERY
CUIROMA GROUP ships its creations worldwide.
Carriers:
DHL Express
FedEx International Priority
Estimated delivery time: 3 to 7 working days after shipment.
Delivery fees are shown before order confirmation.
6.1 — Tracking
Each order has a tracking number sent by email.
6.2 — Delivery address
Any address change is only possible before shipment.
After shipment, no modification is possible.
6.3 — Proof of delivery
DHL or FedEx tracking constitutes official proof of delivery.
6.4 — Refused or unclaimed parcels
In case of refusal or failure to collect the parcel, return, storage, or reshipping fees may be deducted from the refund.
Initial shipping costs remain non-refundable.
6.5 — Carrier delays
Delivery times are indicative.
CUIROMA GROUP cannot be held responsible for delays caused by carriers, customs authorities, security checks, weather conditions, or any event beyond its control.
6.6 — Incorrect address
The customer is solely responsible for the information provided at checkout.
Any reshipping costs will be borne by the customer.
6.7 — Customs checks
Some international shipments may be subject to customs inspections beyond CUIROMA GROUP’s control.
These checks may cause additional delays.
ARTICLE 7 — TAXES AND CUSTOMS
Local taxes, VAT, or customs duties may apply depending on the destination country.
These fees are determined by local authorities and remain the responsibility of the customer when applicable.
ARTICLE 8 — RETURNS, REFUNDS & WITHDRAWAL
8.1 — Non-conforming or defective products
CUIROMA GROUP covers returns in the following cases:
Non-conforming product
Manufacturing defect
Damaged product during transport
Order preparation error
The customer may choose:
Replacement
Repair
Refund
8.2 — Non-covered cases
No returns will be accepted for:
Change of mind
Error in size, color, or model selected at the time of order
Product that is conforming and free of defects
8.3 — Right of withdrawal
In accordance with applicable regulations, the customer has a right of withdrawal where legally applicable.
However, this right does not apply to products:
Made to order
Personalized
Specifically produced for the customer
8.4 — Return procedure
Any request must be accompanied by photos or videos allowing identification of the issue.
ARTICLE 9 — CUSTOMER RESPONSIBILITY
The customer is responsible for:
Accuracy of their address
Accuracy of their phone number
Receipt of the parcel
CUIROMA GROUP cannot be held responsible for customer input errors.
ARTICLE 10 — ARTISANAL WARRANTY
Each product is handmade.
Natural variations related to leather and artisanal production are an integral part of the product’s authenticity.
ARTICLE 11 — FORCE MAJEURE
CUIROMA GROUP cannot be held responsible in cases of:
Strike
War
Natural disaster
Customs blockage
Carrier delay
Pandemic
Major cyberattack
Interruption of communication networks
ARTICLE 12 — PERSONAL DATA
Data is processed in accordance with:
Moroccan Law No. 09-08
GDPR (EU 2016/679)
UK GDPR
Data is used only for:
Order processing
Delivery
Customer service
No data is sold to third parties.
12.1 — Electronic communications
The customer agrees that all communications related to their order may be sent electronically.
ARTICLE 13 — INTELLECTUAL PROPERTY
All website content is protected by intellectual property laws.
Any reproduction, representation, or use without prior written authorization is prohibited.
ARTICLE 14 — CUSTOMER SERVICE

14.1 — Amicable resolution
Before any legal proceedings, the parties agree to seek an amicable solution through CUIROMA GROUP customer service.
ARTICLE 15 — APPLICABLE LAW & JURISDICTION
These TCS are governed by Moroccan law.
Any dispute falls under the jurisdiction of the courts of Fez (Morocco), subject to mandatory consumer protection laws in the customer’s country of residence.
15.1 — Limitation of liability
Within the limits permitted by law, CUIROMA GROUP’s total liability is limited to the amount actually paid by the customer for the relevant order.
15.2 — Contract language
These TCS may be translated into several languages.
In case of discrepancy, the French version shall prevail.
15.3 — International sales and marketplaces
CUIROMA GROUP products may be sold via the official website as well as various international partner platforms.
These TCS apply to all direct sales made by CUIROMA GROUP, subject to mandatory rules applicable on partner platforms.
